Mid-Level Estate Planning employs the use of Family Trusts to streamline management process and minimize estate tax implications of one’s death upon surviving family members. Typically used by couples with children out of the home, and those with significant assets, Family Trusts have legal fees averaging from $1,500 to $3,000.

High Level Estate Planning focuses on circumventing Medicaid long term care expense recovery through the use of specialized trusts and asset transfer. Most individuals desire to leave their assets to loved ones; not to the government. Should nursing home care be needed, Medicaid may place a lien upon a resident’s home to recover its expenses paid on the resident’s behalf. Averaging nearly $8,000 per month, these liens grow rapidly, and can greatly reduce the value of an inheritance. Trust planning solutions must be implemented early, due to the existence of a five-year lookback period applied by Medicaid regulations. Average fees range from $3,000 to $4,000, depending on circumstances.
